1. Acceptance of Terms

By accessing, browsing, or using SAPSAN TERMINAL ("the Service"), operated by Sapsan Krystian Hutyra ("Company", "we", "us", or "our"), you ("User", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease using the Service.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Your continued use after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

SAPSAN TERMINAL is a web-based integrated development environment (IDE) designed for creating, editing, testing, and exporting scripts for Human Interface Device (HID) emulation devices. The Service includes:

• Code editor with DuckyScript and BadUSB syntax highlighting
• Script export functionality for various HID devices (Flipper Zero, USB Rubber Ducky, etc.)
• AI-powered code assistance and generation (Premium feature)
• Script templates and code snippets library
• Script validation and syntax checking

3. Eligibility and Account Registration

To use the Service, you must be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is higher. By creating an account, you represent and warrant that:

• You are legally capable of entering into binding contracts
• All registration information you provide is accurate and truthful
• You will maintain the accuracy of such information
• Your use of the Service does not violate any applicable law or regulation

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You expressly agree NOT to:

• Create, distribute, or deploy scripts for unauthorized access to any computer system, network, or device
• Develop payloads intended to steal credentials, personal data, or financial information without proper authorization
• Use the Service to create tools for conducting denial-of-service attacks
• Violate any applicable local, state, national, or international law or regulation
• Infringe upon or violate the intellectual property rights or privacy rights of others
• Transmit any material that is defamatory, obscene, or otherwise objectionable
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Use the AI features to generate content that violates these Terms or applicable laws
• Resell, redistribute, or sublicense access to the Service without our written consent
• Use automated means (bots, scrapers) to access the Service beyond normal usage

Legitimate Uses Include: Authorized penetration testing, security research with proper permissions, educational demonstrations, IT automation on owned systems, and development of security awareness training materials.

6. AI-Generated Content Disclaimer

The Service includes AI-powered features that generate code suggestions, script completions, and automated assistance. Regarding AI-generated content, you acknowledge and agree that:

• AI-generated content is provided "AS IS" without any warranties of accuracy, completeness, or fitness for any particular purpose
• You are solely responsible for reviewing, testing, and validating any AI-generated code before use
• AI outputs may contain errors, security vulnerabilities, or unintended behaviors
• The Company does not guarantee that AI-generated content will function as intended or be free from defects
• You must not rely on AI-generated content for critical systems without thorough independent verification
• The Company is not liable for any damages resulting from the use of AI-generated content

7. Subscription and Payments

The standard Premium plan costs $14 USD per month. Your subscription amount and billing interval are shown at checkout. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Payment processing is handled by Stripe, Inc., and is subject to their terms of service.

• Billing Cycle: Subscriptions renew automatically at the price and interval accepted at checkout. Prepaid periods are charged upfront
• Cancellation: You may cancel renewal before the next charge through the Stripe customer portal, available from Profile. Access continues until the end of the paid month or year. Once the subscription ends, its protected price ends; a later new subscription uses the offer available at that time
• Refunds: We offer a 14-day money-back guarantee for first-time subscribers, in accordance with EU consumer protection laws (right of withdrawal). After this period, payments are non-refundable except as required by applicable law
• Existing Subscription Prices: Subscriptions keep their agreed base price and billing interval for as long as the same subscription remains active. Once it ends, a new subscription is charged at the current price shown at checkout. Existing discounts keep their original terms

8. Intellectual Property Rights

Your Content: You retain all ownership rights to scripts and content you create using the Service. By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your content solely to provide the Service.

Our Content: The Service, including its design, features, code, templates, documentation, and underlying technology, is owned by Sapsan Krystian Hutyra and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Data Security and Encryption

We implement industry-standard security measures to protect your data, including encryption of stored scripts. However, no method of electronic transmission or storage is 100% secure. You acknowledge that you use the Service at your own risk and are responsible for maintaining the confidentiality of your account credentials.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sapsan Krystian Hutyra, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service
• Scripts you create, distribute, or execute using the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights
• Any claim that your use of the Service caused damage to a third party

12. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Suspected illegal activity or misuse of the Service
• Request by law enforcement or government agencies
• Discontinuation of the Service

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Cooperation with Law Enforcement

We reserve the right to cooperate fully with law enforcement authorities or court orders requesting or directing us to disclose the identity or other information of anyone using the Service. We may report suspected illegal activity to appropriate authorities without notice to you.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in Poland.

For users in the European Union, nothing in these Terms affects your rights under applicable consumer protection laws that cannot be waived by contract.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sapsan Krystian Hutyra regarding the Service and supersede all prior agreements and understandings.
